SKIDMORE C. GARRETT v. JONA M. GARRETT

Robert Vance was the testifying expert with the value that was “most accurate” on a financial advisory business. The trial court adopted Vance’s value which included Enterprise Goodwill at $367,000 with the analysis from Vance and Husband’s testimony that the trail income from his financial advisory business could be assigned for value, and therefore constituted a divisible marital asset.

Tennessee divorce case. Trial court found the "Vance report” and testimony to be credible and adopted my finding that showed Husband had kept his bank accounts separate, including one he maintained to manage funds from rental properties Wife claimed were marital due to transmutation. The appellate court concluded the trial court did not err when it classified five real properties as the Husband’s separate property.

Appellant (ASF) stipulated that its employee was the at-fault driver in a motor vehicle accident involving Appellee (Malone). Appellee and his wife filed suit against Appellant for personal injuries and the issue of damages was tried to a jury, which returned a verdict in favor of Appellees.

At issue was the value of Taylor Animal Hospital (“TAH”). Vance valued TAH in total as of June 30, 2019, at $1,281,502. Applying discounts for lack of marketability (10%) and lack of control (20%), Husband’s 45% interest was valued at $415,000.

This case was post-divorce action concerning modification of the Father’s child support obligation with the major issue being his true income for support. The Messers were Divorced in 2009 and the Permanent Parenting Plan (“PPP”) provided that Father was to pay to Mother $1,000.00 per month in child support, beginning on February 1, 2009.

“This appeal involves a unique divorce proceeding”. Throughout most of the parties’ 29-year marriage, the husband worked as vice president of his father’s railroad construction business, Shelby Railroad. Numerous properties, assets, and accounts were jointly titled in the names of the husband and his father (referred to as Grandfather in the appeal) over the years. When the wife filed a complaint for divorce, she named as defendants not only the husband but also Grandfather.
